Terms of Service

By accessing, browsing, or subscribing to HEVEA Genius — including any of its features, signal feeds, dashboards, or associated services — you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

If you do not agree with any part of these terms, please do not use the platform. Continued use of HEVEA Genius following any update to these terms constitutes your acceptance of the revised agreement.

These terms constitute a binding legal agreement between you and Hevea Investment, a company incorporated and operating from Unit G, 15/F, TAL Building, 49 Austin Road, Kowloon, Hong Kong.

• You must be at least 18 years of age to subscribe to or use HEVEA Genius.
• If you are subscribing on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.
• By completing the subscription process, you confirm your acceptance of all terms set out in this document.

HEVEA Genius is a research and market intelligence platform focused on Bitcoin and Gold. The platform delivers structured signal analysis, on-chain data context, market research tools, and related educational and analytical features depending on your subscription tier.

The HEVEA Genius Research Team publishes signal content based on proprietary methodology. This content is designed to help you understand market structure, momentum, and context — not to direct your investment decisions on your behalf.

• HEVEA Genius does not provide personalised investment advice.
• HEVEA Genius does not provide financial planning, portfolio management, or wealth advisory services.
• All content published on the platform is for informational and educational purposes only.
• Past signal performance does not guarantee or imply future results.
• You remain solely responsible for all investment and financial decisions you make.

HEVEA Genius offers four subscription tiers, each providing a different level of access to platform features, signal layers, and research tools. The current plans are as follows:

• HODL — $12 per month
• PULSE — $29 per month
• NEXUS — $49 per month
• INSTITUTIONAL — $99 per month

Annual billing is available on all plans at a 20% discount. The discounted annual rates are displayed on the Pricing page at the time of subscription.

Each plan provides access to the features and signal layers described on the current Pricing page at heveagenius.io/pricing/. Feature availability may vary by plan. We recommend reviewing the Pricing page for the most up-to-date breakdown of what each tier includes.

Subscriptions begin on the date payment is processed and renew automatically on the same cycle — monthly or annual — unless cancelled prior to the renewal date. You will retain access to your subscribed tier's features for the full duration of the billing period for which you have paid.

Subscriptions are billed in advance on either a monthly or annual basis, depending on the billing cycle you selected at checkout. By subscribing, you authorise HEVEA Genius and its payment processor to charge your nominated payment method on a recurring basis for the applicable subscription fee.

• If a payment fails, your access may be suspended until the outstanding payment is resolved.
• You may cancel your subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period. You will retain access until that date.
• We do not issue prorated refunds for unused time within a billing period, except as described in our 30-day money-back guarantee below.
• HEVEA Genius reserves the right to update its pricing. Where we do, active subscribers will receive reasonable advance notice before any price change takes effect.

The HEVEA Genius Founding Member Programme is available to the first 5,000 subscribers who join the platform during the founding period. Founding Members receive a permanent price lock on their current subscription tier, meaning their rate will not increase as long as their subscription remains continuously active.

How the price lock works

The founding price lock is applied to the specific plan tier that is active at the time of founding membership activation. If you later upgrade or change your plan, the locked rate applies to the tier you held at the time of founding status activation; pricing adjustments on any new tier are subject to the rates in effect at the time of the change.

• The price lock is valid only while the subscription remains uninterrupted and continuously active.
• If you cancel your subscription, the founding price lock lapses permanently.
• Resubscribing after cancellation means rejoining at the standard pricing in effect at the time of resubscription. Founding pricing cannot be reinstated once forfeited.

Founding Member benefits

Beyond the price lock, Founding Members receive a permanent founding badge, a listing on the HEVEA Genius Founding Wall, and a founding record tied to their account. These benefits are permanent and do not lapse upon cancellation, plan change, or any other subscription event. Only the price lock is contingent on continuous subscription activity.

HEVEA Genius is a single-user subscription service. Each account is personal and non-transferable. By subscribing, you agree to use the platform lawfully and in accordance with these terms.

• You may not share your account credentials or grant access to your subscription to any other person.
• You may not resell, redistribute, sublicense, or republish HEVEA Genius signal content, research, or platform materials — in whole or in part — without explicit written permission from Hevea Investment.
• You may not use automated tools, bots, scrapers, or scripts to access, extract, or copy content from the platform.
• You may not use the platform or its content to engage in, facilitate, or promote market manipulation, fraud, or any unlawful financial activity.
• You may not use the platform in any way that causes harm to HEVEA Genius, its infrastructure, or other users.
• Members participating in the HEVEA Genius Affiliate Programme must also comply with the Affiliate Programme Terms, available at heveagenius.io/affiliate-terms/.

Breach of these acceptable use provisions may result in immediate suspension or permanent termination of your account. In cases of serious or intentional breach, no refund will be issued for unused subscription time.

All content published on or accessible through HEVEA Genius — including but not limited to signal analyses, research reports, platform methodology, indicators, algorithms, written commentary, design assets, interface elements, and brand materials — is the intellectual property of Hevea Investment and is protected by applicable intellectual property laws.

• You may not reproduce, modify, translate, distribute, publicly display, or create derivative works from any HEVEA Genius content without explicit written authorisation from Hevea Investment.
• The HEVEA Genius name, logo, and associated branding are protected trademarks of Hevea Investment. You may not use them in any commercial context, co-branding, or public communication without prior written consent.
• Linking to HEVEA Genius content for personal, non-commercial reference is permitted, provided it is done in a manner that is not misleading and does not imply endorsement.

Your data

Your personal account information and any data you submit to the platform remains yours. By using HEVEA Genius, you grant us a limited, non-exclusive licence to process your usage data for the purposes of delivering and improving the service. We may use aggregated, anonymised usage data to develop and refine platform features. We will never sell your personal data to third parties. For full details, please refer to our Privacy Policy.

HEVEA Genius provides the platform and all associated services on an "as is" and "as available" basis. While we work to maintain a reliable, high-quality experience, we cannot guarantee uninterrupted or error-free operation at all times.

• We do not warrant that the platform will always be available, free from errors, or that any signal or analysis will be accurate, complete, or timely.
• Signal content reflects the analysis and judgement of the HEVEA Genius Research Team at the time of publication. Market conditions change rapidly, and no signal or analysis should be treated as a guarantee of outcome.
• We make no warranties — express or implied — regarding the fitness of the platform or its content for any particular purpose, including but not limited to trading, investment, or financial planning.
• Third-party data, tools, or integrations accessible through the platform are provided without warranty. Their accuracy and availability are subject to their respective providers.

Your use of the platform is at your own risk. Nothing in this section is intended to exclude liability that cannot be excluded under applicable law.

To the maximum extent permitted by applicable law, Hevea Investment and its directors, officers, employees, contractors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive losses or damages arising from or in connection with your use of the HEVEA Genius platform.

• This limitation applies regardless of the form of the claim and whether it is based on contract, tort, negligence, or any other legal theory.
• Losses covered by this limitation include, but are not limited to: trading or investment losses arising from reliance on platform content; loss of profits or business opportunity; loss of data; or interruption of access to the platform.
• Our total aggregate liability to you for any claim arising out of or related to your use of HEVEA Genius shall not exceed the total subscription fees you have paid to us in the 12 months immediately prior to the event giving rise to the claim.

Nothing in these terms limits or excludes our liability for fraud, fraudulent misrepresentation, gross negligence, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded or limited.

You may cancel your HEVEA Genius subscription at any time through your account dashboard. Cancellation takes effect at the end of the current billing period, and you retain access to your subscribed features until that date.

Termination by HEVEA Genius

HEVEA Genius reserves the right to suspend or permanently terminate your access to the platform in the following circumstances:

• You have breached any provision of these Terms of Service.
• You have engaged in fraudulent, abusive, or unlawful activity in connection with the platform.
• Payment for your subscription has lapsed and has not been resolved within a reasonable notice period.
• Your use of the platform poses a risk to other users, the platform's integrity, or Hevea Investment.

Where HEVEA Genius terminates your access for breach of these terms, no refund will be issued for any unused subscription time.

Effect of termination

Upon termination, your access to the platform and its gated features ceases immediately. Your founding record, badge, and Founding Wall listing (where applicable) are retained as permanent read-only records and are not deleted. Any provisions of these terms that by their nature should survive termination — including intellectual property, disclaimers, and limitation of liability — will continue to apply.

HEVEA Genius may update these Terms of Service from time to time to reflect changes to our platform, services, legal requirements, or business practices. We are committed to keeping you informed of any material changes.

• For material changes to these terms, active subscribers will receive advance notice via email or an in-platform notification at least 14 days before the changes take effect.
• Minor or administrative changes — such as corrections to formatting or contact details — may be made without prior notice.
• Your continued use of the HEVEA Genius platform after the effective date of any updated terms constitutes your acceptance of those changes.
• If you do not agree with a material change, you may cancel your subscription before the change takes effect.

These Terms of Service are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China, without regard to its conflict of law principles.

• Any dispute, claim, or controversy arising out of or in connection with these terms — including their existence, validity, interpretation, performance, breach, or termination — shall be subject to the exclusive jurisdiction of the courts of Hong Kong.
• If you are accessing HEVEA Genius from a jurisdiction outside Hong Kong, you do so voluntarily and are responsible for compliance with local laws applicable to your use of the platform.
• If any provision of these terms is found by a court of competent jurisdiction to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible. The remaining provisions shall continue in full force and effect.
